Terms & Conditions

1. Introduction

These Terms & Conditions govern the use, participation, and engagement with Wingers Wave ("the Company," "the Platform,"), including all its systems: Talent Platform, Idea Yangu, Business Marketplace, Bonga Nasi, and Ticketing/Events.

By accessing, registering, or participating in any part of the Platform, you confirm that you have read and understood these Terms, agree to be legally bound by them, and accept all policies, structures, and operational systems.

2. Legal Status & Compliance

Wingers Wave operates in alignment with the Constitution of Kenya (2010), applicable laws of the Republic of Kenya, and Data Protection Acts.

The platform upholds transparency, accountability, equality, fairness, and legal protection of all stakeholders.

3. Voluntary Participation

Participation in the Platform is entirely voluntary, based on your own free will, and without coercion, pressure, or influence. By joining, you confirm you are acting independently.

4. Membership & Eligibility

Membership requires registration, accurate and verifiable information, compliance with all platform guidelines, and approval by internal system processes.

The Company reserves the right to approve or reject any application, verify identity, and suspend or terminate accounts.

5. No Guarantee of Opportunities

Wingers Wave is an opportunity ecosystem, not a guarantee system.

Membership does NOT guarantee income, funding, exposure, or success. Opportunities depend on performance, merit, engagement, and evaluation results. Final decisions are made by the Technical Team and Approved Review Team.

6. Evaluation & Approval Process

All access to opportunities is based on profile review, eligibility criteria, technical assessment, and internal evaluation. The Company has exclusive authority to select, approve, reject, or recommend based on these evaluations.

7. Membership Fees & Payments

Activation Fees:

• Talent Platform: KES 1,000/year
• Idea Yangu: KES 1,000/year
• Bonga Nasi: KES 700/year
• Marketplace: Package-based pricing

All payments are final and non-refundable. Payments must be made through approved system channels (e.g., M-Pesa). Off-platform payments are strictly prohibited.

8. Content & IP

Users retain ownership of their content. The Platform has rights to display, promote, and distribute content on the platform. Prohibited content includes illegal, offensive, defamatory, or misleading material.

9. Liability & Limitations

The platform is NOT responsible for business transactions, agreements between users, or third-party actions. Use of the platform is at your own discretion.

10. Governance & Dispute Resolution

Governed by Kenyan law and strictly subject to the jurisdiction of Kenyan courts. Terms may be updated at any time, and continued use of the platform constitutes acceptance.
